Settlement with DoorDash over unpaid tips

The Office of the New York State Attorney General (OAG) has secured a settlement for $16.75 million with DoorDash to return unpaid tips to New York delivery workers (Dashers). Between May 2017 and September 2019, some Dashers did not receive the full tips they were due.

The deadline to file a claim is September 30, 2025.

Overview Of DoorDash settlement

Between May 2017 through September 2019, some Dashers working in New York state did not receive their full tips. The OAG investigated DoorDash and negotiated a settlement. The settlement created a fund to pay affected Dashers and new benefits to protect current Dashers.

Settlement fund of $16.75 million to repay eligible Dashers

As a current or former Dasher, you may be eligible for payments if both of the following apply to you:

• You used the DoorDash app to deliver food in New York state between May 2017 and September 2019

• DoorDash applied some of your customer tips to DoorDash’s guaranteed payment

The OAG has hired Atticus Administration LLD (Atticus) to be the settlement administrator in this case. Atticus will:

send notices to Dashers who are eligible for payment from the settlement fund

process Dasher payments

• answer questions related to payments from the Dasher fund

We expect to notify qualifying individuals beginning in mid April 2025.

The deadline to file a claim is September 30, 2025. You must complete and submit the claim form (by mail or online) by this date. In this form you will select how you would like to receive your payment. In connection with payment of your claim, you will receive IRS Form 1099 for tax purposes.

Benefits for current and former Dashers

DoorDash will ensure the following for Dashers who use DoorDash’s app to deliver food in New York state.

For all Dashers:

• You will receive the full amount of tips that customers pay you.

• DoorDash will pay you the full amount that it guarantees to pay you.

• DoorDash will maintain disclosures about its pay model for both Dashers and DoorDash customers.

• There will be a hyperlink or something similar to easily get the information about the pay model on the Dasher mobile app.

• This information will be easily visible on the DoorDash website and app too.

• Before accepting a delivery order, you will see the following information in the mobile app:

○ Estimated distance to complete the order.

○ Minimum pay you will receive from DoorDash if you accept the order.

• For each past delivery, you will be able to see your Dash History. This is the breakdown between your total compensation paid by DoorDash and the total tip paid by your customer:

○ You will be able to see this information on the app for deliveries within the past five months (but no more than 200 delivery sessions).

○ You can request your Dash History and some delivery information (date, time, approximate distance if available, and merchant you delivered for) for four years. 

The following applies if you deliver for DoorDash outside of New York City and are not subject to New York City minimum-pay-rate requirements:

• For each delivery, DoorDash must provide you with an itemized summary of pay information after you complete a delivery session. A session starts when you make yourself available to receive orders through the Dasher app and ends when you stop taking orders:

○ base pay

○ amount of compensation paid by DoorDash (including a breakdown of promotional pay, bonuses, and similar pay)

○ amount of the consumer tip on that order


In accordance with the New York State Personal Privacy Protection Law, any personal information that you may provide, such as your name, address, and/or banking information, will only be used only to process your payment. Atticus will retain your information in a secure database only long enough to process your payment and report that payment to OAG. The OAG has sole discretion on the amount of all settlement payments, based on the information provided by DoorDash. This means that OAG makes the final decision on what these payment amounts are.

However, if you owe money for New York child support or other judgments, these amounts may be subtracted from your award amount. If this is the case, you will receive a notice from the appropriate New York agency. You will have 14 days to respond to that notice.
